What this bill does
In plain words · AI-written from the official summaryCounts observation days toward Medicare nursing care requirement
Medicare requires patients to spend at least three days in a hospital as an inpatient before they can get coverage for skilled nursing facility services—basically, temporary care at a nursing facility after a hospital stay. Right now, when hospitals keep patients under observation to figure out whether they need to be admitted, that observation time doesn't count toward the three-day requirement. This bill would change that by counting observation days the same as inpatient days.
How it affects you
If you're a Medicare beneficiary, this could help you qualify for nursing facility coverage more easily. Instead of waiting for a full three-day hospital admission, time spent under observation might now count, potentially getting you access to nursing care sooner after a hospital visit.

Improving Access to Medicare Coverage Act of 2026
This bill deems an individual receiving outpatient observation services in a hospital as an inpatient for purposes of satisfying the three-day inpatient hospital-stay requirement with respect to Medicare coverage of skilled nursing facility (SNF) services. (Generally, individuals must have been an inpatient at a hospital for at least three days in order to qualify for SNF services. An individual's time spent under observation at a hospital for purposes of determining whether the individual should be admitted does not count towards this requirement.)
