Extending renewal periods for certain home and community-based services waivers and State plan amendments under Medicaid

Section 1915 of the Social Security Act (42 U.S.C. 1396n) is amended— (1) in subsection (c)(3), by inserting (or, with respect to extensions of waivers beginning on or after the date of the enactment of the Medicaid Empowerment Act of 2025, 10-year periods) after five-year periods; (2) in subsection (h)(2), by inserting (or, with respect to extensions of waivers under subsection (c) beginning on or after the date of the enactment of the Medicaid Empowerment Act of 2025, 10-year periods) after 5-year periods; and (3) in subsection (i)(7)(C), by inserting (or, with respect to renewals of elections beginning on or after the date of the enactment of the Medicaid Empowerment Act of 2025, 10-year terms) after 5-year terms.
