None of the funds made available by this Act may be used by the Administrator of the Federal Aviation Administration (FAA) to withhold from consideration and approval any new application for participation in the contract tower program, or for reevaluation of cost-share program participants so long as the FAA has received an application from the airport, and so long as the Administrator determines such tower is eligible using the factors set forth in FAA published establishment criteria.
