Dual compensation

The Administrator may waive the application of subsections (a) through (h) of section 8344, or subsections (a) through (e) of section 8468, of title 5, United States Code, on a case-by-case basis, for— (1) an employee of the Federal Emergency Management Agency in a position for which there is exceptional difficulty in recruiting or retaining a qualified employee; or (2) an employee of the Federal Emergency Management Agency serving on a temporary basis, but only if, and for so long as, the authority is necessary due to an emergency involving a direct threat to life or property or other unusual circumstances.
