The Secretary of State may waive the application of any provision under this Act by certifying to the Committee on Foreign Relations of the Senate, the Committee on Foreign Affairs of the House of Representatives, the Committee on Homeland Security and Governmental Affairs of the Senate, and the Committee on Oversight and Government Reform of the House of Representatives that— (1) such waiver is in the national security or foreign policy interests of the United States; (2) the implementing partner that would be negatively affected by such provision is the only provider of the specific services for which the nonmilitary foreign assistance would be used; (3) the requested scope of the waiver is narrowly tailored to only include such services; and (4) the implementing partner has made a good faith effort to comply with such provision.
