EVUS fee

(a) In general In addition to any other fee authorized by law, the Secretary of Homeland Security shall impose on any alien subject to the Electronic Visa Update System a fee in the amount specified in this section at the time of such alien’s enrollment in the Electronic Visa Update System. (b) Amount For purposes of this section, the amount specified in this section for fiscal year 2025 shall be such amount as the Secretary may by rule provide, but in any event not less than $30. (c) Subsequent adjustment Beginning in fiscal year 2026 and each fiscal year thereafter, the amount specified in this section for a fiscal year shall be equal to the sum of— (1) the amount imposed under this section for the prior fiscal year; and (2) rounded to the next lowest multiple of $0.25, the amount referred to in paragraph (1), multiplied by the percentage (if any) by which the Consumer Price Index for All Urban Consumers for the month of July preceding the date on which such adjustment takes effect exceeds the Consumer Price Index for All Urban Consumers for the same month of the preceding calendar year. (d) Crediting of funds (1) In general The fees received under this section shall be deposited into the CBP Electronic Visa Update System Account, less $5 per enrollment which shall be credited as offsetting receipts and deposited into the general fund of the Treasury. (2) Establishment Notwithstanding any other provision of law, there is hereby established in the Treasury of the United States a separate account which shall be known as the CBP Electronic Visa Update System Account. (3) Appropriation Amounts deposited in the CBP Electronic Visa Update System Account are hereby appropriated to make payments and offset program costs as specified in this section without further appropriation necessary and shall remain available until expended for any U.S. Customs and Border Protection costs associated with administering the Electronic Visa Update System. (e) No waiver A fee imposed under this section shall not be waived or reduced.
