(a) Administrative procedure Section 304(a) of the Federal Water Pollution Control Act (33 U.S.C. 1314(a)) is amended by adding at the end the following: (10) Administrative procedure In developing any criterion under this subsection, the Administrator shall carry out a rulemaking under section 553 of title 5, United States Code.. (b) Judicial review Section 509(b)(1) of the Federal Water Pollution Control Act (33 U.S.C. 1369(b)(1)) is amended, in the first sentence— (1) by striking 402, and (G) and inserting 402, (G); and (2) by inserting (H) in finalizing any criteria under section 304(a), and (I) in defining the scope of the term waters of the United States for purposes of this Act, after section 304(l),.
