Section 3706(c) of title 10, United States Code, is amended— (1) in paragraph (3), by striking; or and inserting a semicolon; (2) in paragraph (4), by striking the period and inserting; or; and (3) by adding at the end of the following: (5) the cost or pricing data were submitted by the prime contractor or subcontractor after the date of agreement on the price of the contract or, if applicable consistent with subsection (a)(2), such other date agreed upon between the parties..
